1. Agreement to Terms

By scheduling, purchasing, or using any services provided by Erie Pooper Scoopers company, you (“Client,” “you,” or “your”) agree to be legally bound by these Terms of Service (“Terms”). These Terms constitute a binding legal agreement between you and the Company. If you do not agree to these Terms, you must not use our services.

2. Scope of Services

We provide routine pet waste removal services for residential and commercial properties, including (but not limited to) weekly dog waste pickup and optional deodorizing of serviced areas.

The Company does not provide landscaping, pest control, indoor cleaning, veterinary services, or disposal of waste not related to domestic animals.

3. Access & Client Responsibilities

You agree to ensure we have clear, unobstructed, and safe access to the areas where services are to be performed. This includes, but is not limited to:

  • Ensuring gates are unlocked
  • Securing all pets away from the area during service hours
  • Keeping the yard clear of hazards, aggressive animals, snow, and excessive debris

We are not responsible for lost or escaped pets. If a gate is left unlocked by the Client or if a pet escapes during or after our visit, the Client assumes full responsibility. By using our services, you expressly waive and release Erie Pooper Scoopers from all liability related to the loss, injury, or death of any pet.

4. Service Schedule & Missed Visits

Service is typically provided once or twice per week, unless otherwise agreed in writing. If we are unable to access your property on a scheduled day due to weather, locked gates, blocked entrances, or other issues beyond our control, the visit will be marked as missed. In such cases, we reserve the right to:

  • Skip the service and resume on the next scheduled date
  • Charge the full rate for the missed visit
  • Decline credits or refunds

5. Initial Cleanups, Add-Ons, & Extra Waste

Initial cleanups for yards with excessive waste (more than 1 week’s accumulation) are subject to an additional one-time fee based on volume and condition. Large yards, multiple-dog households, or requests for additional services (e.g., deodorizing spray) may incur additional fees.

All fees will be disclosed and agreed upon in advance.

6. Payment & Billing

All services are billed on a prepaid monthly basis and are due on the 1st of each month. We accept payments via credit card.

Failure to pay may result in immediate service suspension or termination. Returned payments or declined transactions may incur a processing fee. We reserve the right to adjust pricing with thirty (30) days' advance written notice.

7. Refunds & Cancellations

You may cancel services at any time by providing at least five (5) business days’ written notice prior to the next billing cycle. No refunds will be issued for unused portions of a billing period after payment has been processed.

8. Weather Policy

In cases of hazardous weather conditions, including but not limited to snow, ice, lightning, or extreme heat, we may postpone or skip service at our sole discretion for the safety of our technicians. Missed services due to weather will not be refunded but may be rescheduled; normal service will resume on your next scheduled visit.

9. Poop-Free Guarantee

If you believe we missed any areas, you must notify us within twenty-four (24) hours of the completed service. We will return at no cost to address the concern. This guarantee does not apply if the waste was obscured, buried, frozen, located outside the agreed service area, or excessively accumulated.

10. Indemnification & Liability Waiver

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Erie Pooper Scoopers and its employees, contractors, and representatives from and against all claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising out of:

  • Damage to property, landscaping, fences, or fixtures during routine services
  • Injury or death of any pet or animal, including but not limited to escapes due to open gates or fencing
  • Exposure to pathogens, diseases, allergens, or environmental conditions associated with pet waste
  • Failure to maintain your property in a safe and accessible condition

You acknowledge that pet waste, even after removal, may pose a risk to health and sanitation, and you agree to assume all such risks.

11. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL ERIE POOPER SCOOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PETS, LOSS OF INCOME, OR EMOTIONAL DISTRESS. OUR MAXIMUM LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR SERVICES IN THE THIRTY (30) DAYS PRIOR TO THE INCIDENT.

12. Privacy Policy

We collect only the personal information required to provide services and communicate with you. We do not sell or share your data with any third party, except as necessary to provide our services or as required by law.

13. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon being posted to our website or sent via email. Continued use of our services after any modifications constitutes your acceptance of the revised Terms.

14. Governing Law & Venue

These Terms shall be governed by the laws of the State of Colorado. Any dispute arising under these Terms shall be brought exclusively in a state or federal court located in Weld County, Colorado, and both parties submit to the jurisdiction thereof.
